MORE than 100 cases against those who violated the city’s waste segregation policy, which took effect last July 1, are set to be filed in court.
Records from the City Prosecution Office (CPO) showed a total of 119 cases filed before their office and are set to be recommended to the Municipal Trial Court in Cities (MTCC).
Of the 119 cases, 101 are in violation of Section 44 of Ordinance No. 361-10 Series of 2010 or "Ordinance Providing for an Ecological Solid Waste Management, Prohibiting Certain Acts and Providing Penalties for Violations and for other Purposes".
Of these cases, 18 are with violation of Republic Act 9003, otherwise known as "Ecological Solid Waste Management Act of 2000".
City Environment and Natural Resources Office (Cenro) chief Joseph Dominic Felizarta said the office can actually file a case twice -- on the fourth offense, and if violators fail to pay the fines for the first to fourth offenses.
For the first offense, a violator would have to pay a P300 fine and one-hour mandatory segregation lecture that will be conducted by barangay officials and Cenro, while second offenders will have to pay P500 fine or render five days community service at eight hours per day.
For the third offense, a violator would pay P1,000 fine or 10 days community service, while a case will be filed before the court against fourth offenders.
