THE City Prosecutor's Office (CPO) formally filed charges against a father accused of raping his 13-year-old daughter in March this year.
Prosecutor Lady Juris Zozobrado summoned the 48-year-old respondent but the latter failed to submit any "controverting evidence."
In her affidavit, the victim said she was sleeping around 12 noon of March 9, when she was awakened by someone kissing and touching her.
"Ayaw saba kay mapriso ko (Don’t make a noise lest I land in jail)," the girl quoted her father as saying before raping her.
After molesting her, the victim said her father embraced her tight and said, "Dili nako mamunal, dili nako manghilabot sa imoha (I will no longer spank you nor interfere with what you’re doing)."
The man then said he will be watching television at a neighbor’s house.
The girl said she took the P60 left on her table and told her father she just needs to return a notebook she borrowed from her classmate.
She went to a friend's house and advised to tell her father that she went to a beach resort, if he comes and look for her.
She instead went to her grandmother’s house in Calinan.
When her mother and younger sister came to fetch her around 11 p.m. of the same day, she cried and refused to go with them. Her mother then asked what her problem was and she told them what her father did.
Early morning of the next day, she and her mother left and went to the hospital for medical examination and reported the incident to Talomo Police Station.
No bail was recommended for the respondent's temporary liberty.
